first and second degree murder charges! Working alongside Attorney Gary
Gibson, Silldorf helped his client avoid potential life-in-prison penalties
and instead limit the conviction to a voluntary manslaughter conviction.
The client in this case was a 32-year-old pharmacist with no criminal history,
who allegedly shot and killed the victim. Prior to the shooting, the defense
introduced evidence in the form of text messages the alleged victim had
sent to their client, threatening possible violence and calling him derogatory names.
When the accused’s roommate came to the apartment to collect her
belongings, the heavily-intoxicated victim, who had been previously told
he was no longer welcome at the accused’s home, decided to also
follow. Evidence at trial supported that the victim was drunk, furious,
and looking to fight Attorney Silldorf’s client.
Silldorf’s client shot the victim twice, once in the neck, and once
in the chest from inside his own home. The victim died on scene. Silldorf’s
client turned himself in to police after going missing for eight hours
after the shooting event.
The defense had to deal with additional bad facts that were submitted by
the prosecution, including homicidal/suicidal ideation and text messages
stating his intent to “kill” his ex-roommate’s boyfriend.
While the prosecution tried to use these as a demonstration of pre-meditation
and intent, the defense was able to overcome these bad facts and presented
compelling evidence that the shooting was done in law ful self-defense
with a lawful firearm—used against an intruder who was told he was
not welcome in his home, and who was clearly looking to start a violent
