Client—a 32-year-old San Diego pharmacist with no criminal record—was charged with first degree murder with a gun. He shot and killed his roommate’s boyfriend at the door step of his condominium shortly after receiving threatening text messages from him. The district attorney’s office made no offers before trial. Our defense team argued our client acted in perfect self-defense. The jury returned a verdict of not guilty on both first and second degree murder with a gun.

Client received a time-served sentence having served approximately 30 days in custody. Client was facing a 3 year, minimum-mandatory sentence.

Unarmed client was grabbed, struck by the officer’s knee, pepper sprayed in the face (twice), and shot in the back with a Taser weapon from the top of a staircase. This propelled him forward, toppling down the stairs, and causing serious bodily injury. The officer activated the Taser weapon a second time as the client lay on the ground with a fractured arm—unable to comply with the officer’s repeated commands to place his arms behind his back. Defendants requested to mediate and ultimately settled for a confidential monetary amount to client, pre-trial.
